The fault does not matter when it comes to workplace injuries. In the case of workplace injuries, employees are entitled to cash and medical care, along with their regular wages, when not able to perform their daily duties.

In the Worker’s Compensation case, no party is determined to be at fault and will not be a determining factor of the compensation amount. However, injuries arise outside of work scope or from the intent to insure him/herself, or someone else will not be considered as Worker’s Compensation claim.

Claims are typically paid if the employer or insurance carrier agrees that the injury or illness is work-related. Employers are also entitled for coverage.
